FERC's Latest Filings Detail Significant Shifts in Electric Corporate Ownership, Rate Structures, and Energy Development

The Federal Energy Regulatory Commission (FERC) issued a combined notice of filings on July 13, 2026, providing a crucial update on various regulatory actions shaping the national energy landscape. This notice details a broad spectrum of electric utility corporate transactions, adjustments to rate schedules, and applications for market participant certifications. It offers a transparent look at the routine yet pivotal regulatory processes essential for maintaining a stable and competitive electricity market, with several deadlines set for public comment.

Electric Corporate Filings: Mergers and Acquisitions Under Review

The notice identifies several electric corporate filings, primarily Joint Applications for Authorization Under Section 203 of the Federal Power Act. This section of the Federal Power Act requires FERC approval for utility mergers, consolidations, acquisitions of utility facilities, or dispositions of such facilities. The purpose of this oversight is to ensure that such transactions do not negatively affect competition, rates, or regulation.

Among the significant entries is a supplement filed by Bridgeport Energy LLC, Essential Power Massachusetts, LLC, Essential Power Newington, LLC, Essential Power OPP, LLC, Essential Power Rock Springs, LLC, Hamilton Liberty LLC, Hamilton Patriot LLC, Hamilton Projects Acquiror, LLC, Lakewood Cogeneration, L.P., Nautilus Power, LLC, Revere Power, LLC, Rumford Power LLC, Tiverton Power LLC, and Vistra Corp. under Docket Number EC26-63-000. This indicates ongoing adjustments or further information provided for an earlier corporate transaction.

Additional Section 203 applications include filings from GRP Franklin, LLC, GRP Madison, LLC, GRP TE Lessee, LLC, and Pacolet Milliken, LLC (EC26-123-000). Winslow Power Acquisitions LLC, Beaver Falls, L.L.C., Casco Bay Energy Company, LLC, and Syracuse, L.L.C. also jointly applied (EC26-124-000). Montour, LLC, and Chief Keystone Power, LLC submitted another joint application (EC26-125-000). These numerous applications signal continued consolidation and strategic restructuring within the power generation and transmission sectors, reflecting companies' efforts to adapt to evolving market demands and regulatory environments.

Exempt Wholesale Generator Status: Promoting New Power Sources

The Commission also received an exempt wholesale generator filing. Abes Run Solar LLC, under Docket Number EG26-271-000, submitted a Notice of Self-Certification of Exempt Wholesale Generator Status. An Exempt Wholesale Generator (EWG) is a generating facility that sells electricity exclusively at wholesale and is exempt from certain federal regulatory requirements. This status facilitates the development of new power generation, particularly from renewable sources like solar, by reducing regulatory burdens and encouraging market entry.

Complaints and Compliance: Addressing Market Operations

In the realm of complaints and compliance, the notice lists a Petition for Declaratory Order from Cycle Horseshoe Bend Wind LLC and United Materials, Inc. (EL26-88-000 and QF02-131-007). A Petition for Declaratory Order requests FERC to issue a definitive ruling on a specific question of law or fact, often clarifying regulatory obligations, interpretations, or the rights of parties involved in energy markets. This type of filing is typically used to resolve uncertainties before potential disputes escalate.

Additionally, a Refund Report from Cycle Horseshoe Bend Wind, LLC (QF02-131-006) was filed. This suggests an adjustment or resolution related to a qualifying facility's operational or financial aspects, possibly stemming from a previous compliance issue or regulatory ruling.

Electric Rate Filings: Regulating Energy Commerce

A significant portion of the notice is dedicated to electric rate filings, submitted under Section 205(d) of the Federal Power Act. This section mandates that utilities file any new rates or changes to existing rates with FERC, which then reviews them for justness and reasonableness. These filings are fundamental to the economic framework of the energy industry, influencing the cost of electricity and the financial viability of energy infrastructure.

The Southwest Power Pool, Inc. (SPP) made multiple Section 205(d) rate filings (ER26-3108-000 through ER26-3111-000) concerning NPPD Generation Interconnection Agreements (GIAs), all effective June 15, 2026. These filings indicate new or modified agreements for connecting power generation facilities to the transmission grid managed by SPP, reflecting ongoing development and integration of generation resources within its footprint.

Keystone Appalachian Transmission Company (ER26-3112-000) submitted an amended Interconnection Agreement and Service Agreement, effective September 7, 2026. Sierra Pacific Power Company and Nevada Power Company (ER26-3113-000) filed a Transmission Interconnection Agreement with Plumas Sierra, effective July 9, 2026, highlighting cooperative efforts in transmission infrastructure.

Midcontinent Independent System Operator, Inc. (MISO) filed a GIA for ITC Midwest-Elk Creek Solar (ER26-3114-000), effective July 1, 2026. Ohio Power Company (ER26-3115-000) submitted a Facilities Agreement related to an Interconnection and Large Generation Service Agreement, effective October 1, 2026. Tucson Electric Power Company (ER26-3116-000) filed a Service Agreement effective June 8, 2026. AEP Texas Inc. made two notable filings: a Tariff Amendment for the Pajarita BESS (Battery Energy Storage System) Generation Interconnection Agreement Cancellation (ER26-3117-000), effective June 28, 2026, and a Facilities Development Agreement for the Hog Creek project with Concho Valley EC and Golden Spread EC (ER26-3118-000), effective June 17, 2026. These diverse filings demonstrate active management of grid connections, the integration of new technologies like battery storage, and the ongoing development of both conventional and renewable energy projects.

Regulatory Process and Public Engagement

All filings are accessible through FERC's eLibrary system, underscoring the Commission's commitment to transparency. Interested parties have specific comment deadlines, typically 5 p.m. ET on various dates in July and August 2026, to intervene, protest, or comment on these proceedings. This public engagement mechanism allows stakeholders, including other utilities, consumer groups, and environmental organizations, to voice concerns or provide input before FERC makes final decisions. The Office of Public Participation offers assistance for those wishing to engage in the regulatory process.

These routine but critical regulatory actions collectively shape the future of the nation's electricity grid and energy markets, reflecting the ongoing evolution towards a more diverse and interconnected energy infrastructure.
