Non-DOT Reasonable Suspicion Training for Supervisors

Non-DOT Reasonable Suspicion Training for Supervisors is a 2-hour online course for employers and supervisors operating outside the scope of Department of Transportation regulations. While non-DOT employers are not subject to federal testing mandates, untrained supervisors who act on reasonable suspicion without proper documentation or established procedures expose their organization to wrongful termination claims, discrimination lawsuits, and significant legal liability. This course eliminates that risk.

Developed by Andrew David Easler, Esq., an attorney and nationally recognized authority on drug-free workplace compliance, this course equips supervisors with the knowledge and skills to recognize the physical, behavioral, speech, and performance indicators of probable drug use and alcohol misuse, establish reasonable suspicion based on specific and articulable observations, properly document those observations, and follow the correct steps for initiating a drug or alcohol test in a non-DOT regulated environment.

Many states, industries, and employer drug-free workplace programs require or strongly recommend supervisor training as part of a compliant program. Completing this training helps organizations demonstrate documented due diligence, strengthen their legal position in the event of a dispute, and build a workplace culture where safety and accountability are consistently enforced.

Specialized Non-DOT reasonable suspicion training is also available for Iowa-regulated employers, including Iowa Initial Reasonable Suspicion Training for Supervisors and Iowa Reasonable Suspicion Training for Supervisors (Refresher/Annual), which meet the specific training requirements under Iowa law.

Available as online self-paced training, on-site instructor-led training, or SCORM courseware for use in third-party learning management systems. Certificates are available for immediate download upon completion.

Non-DOT Reasonable Suspicion Training for Supervisors is a self-paced, 2-hour online course created by Andrew David Easler, Esq., an attorney and nationally recognized authority on drug and alcohol compliance and drug-free workplace law.

Non-DOT refers to employers and industries that are not subject to the Department of Transportation's drug and alcohol testing regulations, which govern safety-sensitive employees in sectors such as trucking, aviation, railroads, transit, maritime, and pipelines. Non-DOT employers operate under their own drug-free workplace policies, applicable state laws, and any industry-specific requirements that apply to their workforce. While the regulatory framework differs from DOT-regulated environments, the underlying need for trained supervisors who can recognize and respond to reasonable suspicion situations remains equally important.

Reasonable suspicion is a documented, fact-based determination grounded in specific, immediate, and articulable observations of an employee's appearance, speech, behavior, or body odor that suggest potential substance abuse. For example, a supervisor may observe bloodshot eyes, slurred speech, an unsteady gait, unusually aggressive behavior, a noticeable change in work performance, or the smell of alcohol. When these observations are properly documented and reported, they establish the legal basis for ordering a drug or alcohol test under the organization's drug-free workplace policy.

The consequences of getting this wrong are significant. Supervisors who act on reasonable suspicion without proper training, documentation, or an understanding of correct procedures expose their organization to wrongful termination claims, discrimination lawsuits, and costly legal disputes. Many states have enacted drug-free workplace laws or programs that require or strongly recommend reasonable suspicion training for supervisors, particularly in industries where safety is critical such as construction, manufacturing, healthcare, and transportation. Documented supervisor training is one of the most effective ways an organization can demonstrate due diligence and protect itself from legal and financial liability.

This course ensures supervisors understand exactly what constitutes reasonable suspicion, how to document observations accurately, when and how to initiate testing, and how to refer employees to appropriate support resources, including Employee Assistance Programs (EAP). By combining clear regulatory guidance with real-world application, the course prepares supervisors to handle reasonable suspicion situations confidently, consistently, and in ways that withstand legal scrutiny.

For Iowa-regulated employers, specialized Non-DOT reasonable suspicion training is available that meets the specific training requirements under Iowa law, including Iowa Initial Reasonable Suspicion Training for Supervisors and Iowa Reasonable Suspicion Training for Supervisors (Refresher/Annual).

Training certificates earned through this course are recognized in all 50 states and are valid for non-DOT regulated employers across all industries and sectors. After successfully completing the online exam, both supervisors and their managers can immediately download certificates directly from the platform.

By completing this course, supervisors will be able to:

  • Recognize signs of drug and alcohol use by accurately identifying specific, contemporaneous physical, behavioral, speech, and performance indicators of probable drug use and alcohol misuse based on an employee's appearance, behavior, speech, and body odor, establishing the factual basis for a reasonable suspicion determination in a non-DOT regulated environment.
  • Understand non-DOT workplace policy and state requirements by demonstrating working knowledge of the reasonable suspicion standards that apply to non-DOT regulated employers, applicable state drug-free workplace laws, and the organization's own drug-free workplace policies and procedures, including key terms such as "reasonable suspicion," "articulable observations," and the documentation standards required to support a legally defensible testing decision.
  • Make confident and defensible reasonable suspicion decisions by applying the correct process to real-world situations, including when and how to initiate a drug or alcohol test, who to notify, and how to document observations accurately in a way that is consistent with the organization's drug-free workplace policy and capable of withstanding legal scrutiny.
  • Maintain legal and regulatory compliance by understanding supervisor responsibilities under applicable state laws and organizational policies, employee rights, confidentiality obligations, and the legal and financial consequences of making undocumented or improperly handled reasonable suspicion determinations, including wrongful termination claims and discrimination lawsuits.
  • Document and report effectively by completing all required documentation accurately, maintaining proper records of observations and testing decisions, and ensuring every action taken is transparent, consistent with organizational policy, and legally defensible in the event of a dispute or legal challenge.
  • Support and refer employees appropriately by understanding the role of the Employee Assistance Program and other available support resources, and knowing how and when to refer employees to appropriate help when substance abuse issues are identified, thereby fulfilling the supervisor's duty of care while protecting the organization from liability.
